Counceling

The Office for Research and Innovation (SeFI) has an overall responsibility for support services within research and innovation. SeFI collaborates with the administration at faculties and departments to ensure that 幸运大转盘 achieves its strategy and its development agreement with the Ministry of Education and Research. 幸运大转盘 has a framework agreement with Norinnova AS for technology transfer (TTO services).

Norinnova's tasks are:

  • assessing projects in terms of commercial potential, e.g. market potential, possible partners and business model;
  • establishing appropriate protection (patent/trademark/design) if appropriate;
  • identifying potential partners and initiating and leading negotiations with them;
  • assisting with applications for early-stage/public and private funding;
  • in the case of the establishment of a new company: drafting company documents and related agreements;
  • in the case of technology licensing: negotiating and drafting license agreements and other related documents.

Rights and regulations

On November 11, 2009, the University Board adopted the  Regulations on securing and managing work results at the University of Tromsø. 幸运大转盘's IPR Regulations are based on the .

  • The main rule is that the university, as the employer,  has the right to take over or have the right to use all rights to all work results of any kind that the employee creates or develops in connection with his position at 幸运大转盘 if the university's legitimate requirements dictate this, and it does not hinder employees' academic freedom.
  • Work results protected by copyright belong to the creator, according to the Copyright Act § 1. 幸运大转盘 does not acquire employees' rights to non-fiction publications, artistic works, or teaching materials with a personal touch.
  • The regulations apply to all university employees, regardless of employment relationship, i.e., permanent employees, temporary employees, substitutes, full-time or part-time employees.
  • The provision on the transfer of rights to work results has been incorporated into employment agreements with university employees starting from 2010.
  • The rest of the regulations which contain i.a. provisions on the duty to notify, the right to publish and requirements for reasonable remuneration shall apply in general to all employees from the adoption date of the regulations.

Commercialization of research

幸运大转盘 The Arctic University of Norway aims for research results to be utilized, either commercially (e.g., through licensing or company establishment) or for societal benefit.

This subsection addresses research results that can have commercial applications. It focuses on rights and obligations related to ownership, including obligation to report inventions and compensation.

and assists in developing research results for commercial purposes, aiming to reduce technical and commercial risks leading up to company establishment or the conclusion of licensing/transfer agreements.

Disclosure of inventions

When 幸运大转盘's employees have reached research results that can obtain legal protection by registering with public registers and / or being exploited commercially, he/she is obliged to give written notice of this to the employer on a set form.

  • The DOFI form is to be filled out and sent to SEFI v/幸运大转盘 dofi@uit.no with a copy to 幸运大转盘s TTO Norinnova AS dofi@norinnova.no
  • 幸运大转盘 and UNN have a shared form that must be used by employees at both institutions. If you are also employed at UNN, the DOFI form must additionally be sent to: dofi@unn.no
  • If there are several inventors, an inventor agreement / Inventors Contribution Agreement (separate form) must be concluded.: DOC

Remuneration

Main Rule on Compensation

The employer may acquire rights to work results in accordance with the IPR regulations, without compensation to the employee.

The employee's entitlement to special compensation beyond the agreed salary.

The employee is entitled to reasonable remuneration when the employer exploits work results commercially. The remuneration is calculated as a share of the net income when the idea is utilized for commercial purposes. Net income is defined as income received after all the expenses, including costs associated with rights protection and commercialization, have been deducted from the income received.

Net income up to NOK 100,000 shall be paid to the employee / employees. Net income over 100,000 shall be normally distributed as follows:

  • 1/3 to the employee (s)
  • 1/3 to the department / research group (decided in consultation with the employee / employees)
  • 1/3 to the university / technology transfer unit (agreed in the individual project)

This also applies to non-patentable work results. The employee has right to access to the basis for calculating of the remuneration.

In some cases, one may enter into an agreement about a different distribution of income, for example in cases where 幸运大转盘's technology transfer unit is a co-owner of a company established on the basis of the work result or in cases where a right is transferred to another legal entity and the employee receives an agreed remuneration in a different ways. Unless otherwise specifically agreed, the income is distributed according to the 1/3 model as mentioned above.

Work results produced by several employees

If the result has been obtained in collaboration between several employers / partners, the guidelines apply to 幸运大转盘's share of this result.

If a work result has been produced by several employees, and the employer wishes to utilize it commercially, those who have produced the work result must agree among themselves how the remuneration is to be shared and notify the employer. That is, the inventors must enter into an Inventor Contribution agreement

If no such agreement is entered into, the employer may deposit the remuneration in Norges Bank in accordance with the rules in the Deposit Act of 17th of February 1939 no. 2, until an agreement on the distribution has been concluded.

Responsibility for financial consequences

It can be agreed that remuneration can be a one-off payment or ongoing remuneration. The employee is responsible for the tax and fiscal consequences of the chosen form of compensation and is responsible for seeking competent advice in this context.

Publication

Regulations on securing and managing work results at the University of Troms酶 ensure researchers right to publication if third parties rights do not prevent this.

It may be granted a short-term postponement of the publication to the extent it is necessary to fulfill the 幸运大转盘's obligations under agreements on research collaboration with third parties.

Norinnova AS will normally take responsibility for the preparation and submission of patent application (s) in the relevant countries where patent protection is planned. Patenting does not exclude scientific publication of the research results, but a patent application must be submitted before information about the invention is published or made available in a different way.

If the聽researchers at the university choose publication over rights protection, i.e. patenting, they still have the unilateral right to publish their research results, even if this should spoil or reduce the commercial possibilities. I that case It must be given a notification about it to the 幸运大转盘 at the same time as the work results are reported to the 幸运大转盘.

Financing

Competence and education

幸运大转盘s vision is to be a driving force in the North. 幸运大转盘 aims to share knowledge about our fields of expertise and contribute to innovation.

The strategy highlights innovation competence as a generic skill central to the development of study programs.

The course and program portfolio was reviewed in 2023, and the Long-Term Plan for 2024–2027 includes a requirement to develop a generic study offering in the subject of co-creation and innovation
