Employees have a duty to report inventions to the employer, ÐÒÔË´óתÅÌ The Arctic University of Norway. Please refer to the Regulations for securing and management work results at ÐÒÔË´óתÅÌ.

1.1

Counceling

The Office for Research and Innovation (SeFI) has an overall responsibility for support services within research and innovation. SeFI collaborates with the administration at faculties and departments to ensure that ÐÒÔË´óתÅÌ achieves its strategy and its development agreement with the Ministry of Education and Research. By contacting us via innovasjon@uit.no, we will provide further advice and guidance within the innovation system.

ÐÒÔË´óתÅÌ has a framework agreement with Norinnova AS for technology transfer (TTO services).

Norinnova's tasks are:

  • assessing projects in terms of commercial potential, e.g. market potential, possible partners and business model;
  • establishing appropriate protection (patent/trademark/design) if appropriate;
  • identifying potential partners and initiating and leading negotiations with them;
  • assisting with applications for early-stage/public and private funding;
  • in the case of the establishment of a new company: drafting company documents and related agreements;
  • in the case of technology licensing: negotiating and drafting license agreements and other related documents.

Rights and regulations

On November 11, 2009, the University Board adopted the  Regulations on securing and managing work results at the University of Tromsø. ÐÒÔË´óתÅÌ's IPR Regulations are based on the .

  • The main rule is that the university, as the employer,  has the right to take over or have the right to use all rights to all work results of any kind that the employee creates or develops in connection with his position at ÐÒÔË´óתÅÌ if the university's legitimate requirements dictate this, and it does not hinder employees' academic freedom.
  • Work results protected by copyright belong to the creator, according to the Copyright Act § 1. ÐÒÔË´óתÅÌ does not acquire employees' rights to non-fiction publications, artistic works, or teaching materials with a personal touch.
  • The regulations apply to all university employees, regardless of employment relationship, i.e., permanent employees, temporary employees, substitutes, full-time or part-time employees.
  • The provision on the transfer of rights to work results has been incorporated into employment agreements with university employees starting from 2010.
  • The rest of the regulations which contain i.a. provisions on the duty to notify, the right to publish and requirements for reasonable remuneration shall apply in general to all employees from the adoption date of the regulations.

Commercialization of research

ÐÒÔË´óתÅÌ The Arctic University of Norway aims for research results to be utilized, either commercially (e.g., through licensing or company establishment) or for societal benefit.

This subsection addresses research results that can have commercial applications. It focuses on rights and obligations related to ownership, including obligation to report inventions and compensation.

and assists in developing research results for commercial purposes, aiming to reduce technical and commercial risks leading up to company establishment or the conclusion of licensing/transfer agreements.

1.3.1

Disclosure of inventions

When ÐÒÔË´óתÅÌ's employees have reached research results that can obtain legal protection by registering with public registers and / or being exploited commercially, he/she is obliged to give written notice of this to the employer on a set form.

  • The DOFI form is to be filled out and sent to SEFI v/ÐÒÔË´óתÅÌ dofi@uit.no with a copy to ÐÒÔË´óתÅÌs TTO Norinnova AS dofi@norinnova.no
  • ÐÒÔË´óתÅÌ and UNN have a shared form that must be used by employees at both institutions. If you are also employed at UNN, the DOFI form must additionally be sent to: dofi@unn.no

1.3.2

Remuneration

Main Rule on Compensation

The employer may acquire rights to work results in accordance with the IPR regulations, without compensation to the employee.

The employee's entitlement to special compensation beyond the agreed salary.

The employee is entitled to reasonable remuneration when the employer exploits work results commercially. The remuneration is calculated as a share of the net income when the idea is utilized for commercial purposes. Net income is defined as income received after all the expenses, including costs associated with rights protection and commercialization, have been deducted from the income received.

Net income up to NOK 100,000 shall be paid to the employee / employees. Net income over 100,000 shall be normally distributed as follows:

  • 1/3 to the employee (s)
  • 1/3 to the department / research group (decided in consultation with the employee / employees)
  • 1/3 to the university / technology transfer unit (agreed in the individual project)

This also applies to non-patentable work results. The employee has right to access to the basis for calculating of the remuneration.

In some cases, one may enter into an agreement about a different distribution of income, for example in cases where ÐÒÔË´óתÅÌ's technology transfer unit is a co-owner of a company established on the basis of the work result or in cases where a right is transferred to another legal entity and the employee receives an agreed remuneration in a different ways. Unless otherwise specifically agreed, the income is distributed according to the 1/3 model as mentioned above.

Work results produced by several employees

If the result has been obtained in collaboration between several employers / partners, the guidelines apply to ÐÒÔË´óתÅÌ's share of this result.

If a work result has been produced by several employees, and the employer wishes to utilize it commercially, those who have produced the work result must agree among themselves how the remuneration is to be shared and notify the employer. That is, the inventors must enter into an Inventor Contribution agreement

If no such agreement is entered into, the employer may deposit the remuneration in Norges Bank in accordance with the rules in the Deposit Act of 17th of February 1939 no. 2, until an agreement on the distribution has been concluded.

Responsibility for financial consequences

It can be agreed that remuneration can be a one-off payment or ongoing remuneration. The employee is responsible for the tax and fiscal consequences of the chosen form of compensation and is responsible for seeking competent advice in this context.

Publication

Regulations on securing and managing work results at the University of Tromsø ensure researchers right to publication if third parties rights do not prevent this.

It may be granted a short-term postponement of the publication to the extent it is necessary to fulfill the ÐÒÔË´óתÅÌ's obligations under agreements on research collaboration with third parties.

Norinnova AS will normally take responsibility for the preparation and submission of patent application (s) in the relevant countries where patent protection is planned. Patenting does not exclude scientific publication of the research results, but a patent application must be submitted before information about the invention is published or made available in a different way.

If the researchers at the university choose publication over rights protection, i.e. patenting, they still have the unilateral right to publish their research results, even if this should spoil or reduce the commercial possibilities. I that case It must be given a notification about it to the ÐÒÔË´óתÅÌ at the same time as the work results are reported to the ÐÒÔË´óתÅÌ.

Financing

Research that results in discoveries of interest for commercial application or societal benefit often requires further development and market adaptation before commercialization. This may involve additional research or collaboration with end-users to tailor products or processes. There are various funding opportunities available, and regional, national, and international public instrumental  stakeholders have the relevant resources. ÐÒÔË´óתÅÌs vision is to be a driving force in the North. ÐÒÔË´óתÅÌ aims to share knowledge about our fields of expertise and contribute to innovation.

The strategy highlights innovation competence as a generic skill central to the development of study programs.

The course and program portfolio was reviewed in 2023, and the Long-Term Plan for 2024–2027 includes a requirement to develop a generic study offering in the subject of co-creation and innovation

Research and educational leave (FoU-sabbatical)

ÐÒÔË´óתÅÌ aims to increase knowledge production across all academic fields. To achieve this goal, the university will ensure that all academic staff have favorable conditions for research and development work.

The research and education sabbatical is a strategic initiative designed to help ÐÒÔË´óתÅÌ reach this goal. A well-structured sabbatical program is an important tool for recruiting academic staff to ÐÒÔË´óתÅÌ.

Rights

Students own their own research results, ideas and inventions. If ÐÒÔË´óתÅÌ sees a need to take over students' research results, individual agreements must be done. Such an agreement will regulate the parties' rights and obligations. When utilizing the results commercially, students have the same right to reasonable remuneration as ÐÒÔË´óתÅÌ's employees.1/3 model as described in 1.3.2. Remuneration.

Students are not required to report.

Commercialization of research

For P.hd-students

ÐÒÔË´óתÅÌ wants to contribute to an open and innovation-promoting culture. When it comes to commercialization and business establishment, our main focus is on research-based innovations. This is reflected in the instruments that can contribute to this process; be it the Entrepreneurship Fund, or Norinnova's Student Incubator. In addition, ÐÒÔË´óתÅÌ has a number of studiy programs that support innovation, commercialization and entrepreneurship.

PAZZING is a platform where mobile players work together to solve challenges and tasks within a given deadline. Augmented Reality (AR) and geolocations are used, and the result is a kind of "digital treasure hunt".

Keenious develops an algorithm that analyzes the text you write, and searches for research articles and other relevant sources that match exactly what you write.

 

Medsensio

Noises in the lungs can give an indication that something is wrong. Lung sounds can be difficult to detect and interpret using a standard stethoscope. Medsensio develops a smart algorithm based on machine learning that automatically detects and interprets sounds in the lungs.

 

Ventyr

Ventyr is a platform where locals can buy last-minute tickets to experiences. Ventyr helps lower the carbon footprint and increase earnings for tourism companies by utilizing capacity to the maximum, while at the same time giving the local population access to extraordinary experiences at a pleasant price.

There is believed to be a great potential for commercialization and entrepreneurship based on students' activities at Norwegian universities and colleges. In the latest High North report, Norinnova is given 12 million over three years, to a gründer fund. ÐÒÔË´óתÅÌ wants to target the innovation fund at students as well, and Sparebank1 Nord-Norge contributes financially in the entrepreneurship fund to the Idégeneratoren and in Venture Cup.

The Pan-European Seal Programme at EPO and EUIPO

ÐÒÔË´óתÅÌ has from 2023 become a member of the Pan-European Seal Traineeship Program. This is a comprehensive IP programme which bridges academia and the IP labour market. It covers opportunities in many academic areas. Through it, high-achieving young university graduates or students in the last year of their studies can access paid traineeships at the European Union Intellectual Property Office in Alicante (Spain) or the European Patent Office in Munich (Germany), helping them to get a foot in the door of the competitive world of IP through valuable on-the-job multicultural professional work experience. It’s a 12-months traineeship programme. 

To be able to apply candidates need to be shortlisted by the university member. Deadline 20th of Feb. 2024.

The EPO Pan-European Seal Young Professionals Programme (Pan-Seal YPP) offers opportunities within:

The Action Plan for innovation has identified two areas where measures are to be implemented:

  • All of ÐÒÔË´óתÅÌ's educations must meet the National qualifications framework for lifelong learning's requirements for innovation education
  • ÐÒÔË´óתÅÌ will offer innovation and entrepreneurship courses adapted to the characteristics of the various faculties
  • As of 2021, there is a requirement for general innovation competence in all study programs. This is a minimum requirement, but especially the Norwegian School of Management has a very comprehensive offer

Which innovative related courses is there at ÐÒÔË´óתÅÌ?

There is many innovation and commercialising courses at ÐÒÔË´óתÅÌ. Many courses can be taken without prerequisites, while others demands a background in either, bachelor, master's degree or has prerequisites. 

We have innovation courses at the following faculties:

What rights do I have as a student concerning my own research results and ideas?

Students own their own research results, ideas and inventions. If ÐÒÔË´óתÅÌ sees a need to take over students' research results, individual agreements must be done. Such an agreement will regulate the parties' rights and obligations. When utilizing the results commercially, students have the same right to reasonable remuneration as ÐÒÔË´óתÅÌ's employees.1/3 model as described in 1.3.2. Remuneration.

Students are not required to report.

What is a DOFI-form and why do I need to send it in?

When ÐÒÔË´óתÅÌ's employees have reached research results that can obtain legal protection by registering with public registers and / or being exploited commercially, he / she is obliged to give written notice of this to the employer on a set form. ÐÒÔË´óתÅÌ wants the research results to be used commercially, for example through a licensing or start-up, so that it benefits society and pays off financially. Norinnova AS assists ÐÒÔË´óתÅÌ in the work of developing the research results in a commercial direction with the aim of reducing technical and commercial risk towards the establishment of a company or the conclusion of a license agreement / transfer agreement.

 

DOFI form: ÐÒÔË´óתÅÌ and UNN have a common form to be used by employees at both institutions.

The DOFI form is to be filled out and sent to ÐÒÔË´óתÅÌ and / or UNN at the following addresses:

If there are several inventors, an inventor agreement / Inventors Contribution Agreement (separate form) must be concluded.

I have research with a commercial potensial, what do I do?

ÐÒÔË´óתÅÌ wants the research results to be used, either commercially (eg licensing or company establishment) or for the benefit of society. The subchapter "commercialization of research" deals with the research results that may mean commercial application. It is about rights and obligations related to ownership, and also about the duty to report and remuneration.

What is patent and licensing?

A patent consists of a set of exclusive rights granted by a sovereign state to an inventor or their assignee for a limited period of time in exchange for the public disclosure of an invention

For an invention to be patentable it:

  • Must be new (not belonging ti the state of the art);
  • Must involve an inventive step (not easily conceivable by any person having an expertise in the relevant discipline);
  • Must be capable of industrial application (to be used in the industry)

Patenting (the process):

Norinnova always perform a prior art study/patentiability study before patenting

  • Free of cost for inventors - Norinnova cover costs
  • Process involving patent lawyer, inventor(s) and Norinnova
    • Inventors need to support with writing, data and advise
  • No publications before patent is filed!
    • Includes abstract, posters, presentations etc.
    • External collaborations to be secured by confidentiality agreements (CDA/NDA, MTA)
  • Norinnova normally prefer PCT (Patent Cooperation Treaty)
    • "Buy time" (30 months from filing before national phase)
    • Delay major costs uuntil commercial partner is "on board"

The anatomy of a patent

A typical patent consists of four main parts;

  1. Front page(s)
  2. Drawings
  3. Specification
    - A background section
    - A list of drawings
    - A detailed description
  4. Claims
    - Claims are the most important part of the document and describe what the patent does or do not cover!

Licensing

A legal agreemment where an invention can be commercialized by a company. It gives the company permission to use the invention to sell.

What happens for the researcher in the event of licensing?

  • Potential future income from project; inventors (1/3) and research group (1/3)
  • Future collaboration with company?
  • Consulting?
  • Handling over know-how, materials, protocols etc.
  • Support patents
